These general terms and conditions (GTC) govern the use of the website and web app provided by MechanX (hereinafter referred to as “provider”). MechanX offers an AI-powered platform to support workshops. By using our services, you agree to these terms and conditions.
2. Scope
These terms and conditions apply to all users of the provider's website and web app. The terms and conditions apply regardless of whether the use is free of charge.
3. Registration
3.1 Registration: Registration is required to use the web app. Users must provide complete and accurate information and keep their account details up to date at all times. Only persons of legal age and full legal capacity may register.
3.2 Registration process: Registration takes place by entering the email address and confirming the registration via a confirmation email sent to this email address. Registration creates a user account (“Account”).
3.3 Usage restriction: Users are not allowed to create a new account if their existing account has been suspended by the provider.
4. Service description
4.1 Site: The website provides access to an extensive database of DTC codes (Diagnostic Trouble Codes), which can contain various information and instructions.
4.2 Web app: The web app is accessible via the website and offers registered users AI-based functions and analyses to support everyday workshop life. The services offered are currently free of charge.
5. Using the platform
5.1 Responsibility for content: The respective users who distribute content are responsible for the content of their contributions. The provider only provides the technical platform and generally does not check the content, unless this is required by law.
5.2 Permitted use: Users may use the platform's content for both private and professional purposes. Any commercial use, in particular reselling or commercial use of the services and content, is prohibited.

6.1 Content: The provider assumes no liability for any damage. The above disclaimer also applies in favour of the provider's legal representatives and vicarious agents, insofar as claims are made against them.
6.2 Liability: Claims based on injury to life, limb, health and claims arising from the breach of essential contractual obligations are excluded from the exclusion of liability set out in section 6.1. Liability for damage based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents is also excluded from the exclusion of liability.

The provider reserves the right to change these terms and conditions at any time. Users will be notified of changes in good time. Continued use of the services after the changes take effect is considered acceptance of the amended terms and conditions.

9.1 Applicable law: The law of the Federal Republic of Germany applies.
9.2 Jurisdiction: The place of jurisdiction for all disputes arising from or in connection with these terms and conditions is, to the extent permitted by law, the registered office of the provider.
9.3 Salvatory clause: Should any provision of these terms and conditions be ineffective, this does not affect the effectiveness of the remaining provisions. The invalid provision is considered replaced by one which comes closest to the economic purpose of the invalid provision in a legally effective manner.

10.1 MechanX uses OpenAI's large language models to provide various services, including but not limited to text generation and analysis.
10.2 By using MechanX's services, you agree that OpenAI may process your data as part of providing these services.

11. Content rights
11.1 Users may only upload content for which they have the necessary rights.
11.2 By uploading content, users grant the provider a non-exclusive, temporally and spatially unlimited right to use this content. This includes in particular the right to store, reproduce, distribute and make publicly available the content, insofar as this is necessary to provide the services.
11.3 The provider is entitled to remove content that violates these terms and conditions or applicable law.
