As part of outsourcing certain activities, we may transfer personal data to external parties, so-called contract processors, with whom we have concluded order processing agreements and who are not allowed to use your data for their own purposes.

Some external parties are responsible, independently or jointly with MechanX, for processing your personal data, for example when we use cloud services to operate our platform. We also conclude agreements with these parties regarding the careful processing of your data.

External parties who have access to (parts of) your data include:

4. Transfer of personal data

Your personal data will only be stored or processed by us or by commissioned third parties outside the European Union (and the EEA) if this complies with the applicable regulations on the transfer of personal data to countries outside the European Union. This means that we only transfer your personal data to countries outside the European Union if the European Union has decided that the third country in question ensures an adequate level of protection, or if other appropriate guarantees are offered, such as an adequacy decision or the use of standard data protection clauses approved by the European Commission. You can find them at https://ec.europa.eu/info/law/law-topic/data-protection/data-transfers-outside-eu/model-contracts-transfer-personal-data-third-countries_en.

5. Retention periods

We do not keep your personal data longer than is necessary for the purposes for which the personal data is processed, as described in this privacy statement. In certain cases, we are required by law to keep personal data for a longer period of time. If we need to keep personal data longer due to a legitimate interest in protecting our rights or the rights of third parties, we will retain the necessary personal data until the relevant incidents and/or claims have been completed.

If you exercise your right to delete your personal data, you can have your data deleted earlier in some cases. We explain this below under the heading “Your Rights.”

We use the following retention periods:

  • Site usage and cookies (see our cookie policy)

7. Your rights

You can ask us to exercise your rights in relation to your personal data:

  • Information: You can ask us what personal data we process about you. If we do this, we will tell you what personal data is being processed, for what purpose, which third parties it is shared with, the retention periods used, the source from which the personal data may have been collected outside of yourself, and information about any automated decision making. In your own account, you can view most of your data and verify that it is correct.
  • Correction: You can ask us to correct or supplement your personal data if this personal data is incorrect or incomplete. In your own account, you can review and adjust most of your data.
  • Deletion: You can ask us to delete your personal data if the personal data is no longer relevant for the purpose for which it was collected, if consent has been withdrawn, if you object to the processing of personal data based on a legitimate interest, or if the processing of personal data is unlawful. You can delete your own account at any time. Sometimes we are required by law to keep your data for a specific period of time, see the “Retention periods” heading.
  • Restriction of processing: You can ask us to restrict the processing of your personal data if the accuracy of the personal data is disputed, the processing of personal data is unlawful but you do not want it to be deleted, or if you are waiting for a response to a request to exercise the right to object. In this case, we will continue to store the data but will not process it any further.
  • Objection: You can object to the processing of your personal data if the data processing is based on our legitimate interest, including the use of personal data for direct marketing purposes.
  • Data portability: You can ask us to receive your personal data in a structured, up-to-date and machine-readable format or to transfer it to another organization if data processing is automatic and based on consent or a contract.

You can make a request to exercise the above rights by contacting us at team@mechanx.ai. We aim to respond within four weeks of receipt of the request.

You can also file a complaint with the relevant data protection authority if you believe that MechanX has violated your data protection rights.
